THIS AUCTION FEATURES AN AUTO BID EXTEND
AUCTION END TIMES: Liberty Auction and Realty Online Auctions are timed events and all bidding will close at specified time. Liberty Auction Realty Online Auctions also have an auto extend feature. If a bid is placed in the final 5 minutes of bidding, the auction bidding will be automatically extended 5 minutes from the time the bid was placed. Example: If an auction scheduled to close at 6:00 receives a bid at 5:59, the close time will automatically extend to 6:04. The auto extend feature remains active until no further bids are received within a 5 minute time frame.
SERVER AND SOFTWARE TECHNICAL ISSUES: In the event there are technical difficulties related to the server, software, or any other online auction-related technologies, Liberty Auction and Realty reserves the right to extend bidding, continue the bidding, or close the bidding. NEITHER THE COMPANY PROVIDING THE SOFTWARE nor LIBERTY AUCTION AND REALTY SHALL BE HELD RESPONSIBLE FOR A MISSED BID OR THE FAILURE OF THE SOFTWARE TO FUNCTION PROPERLY FOR ANY REASON. Email notifications will be sent to registered bidders with updated information as deemed necessary by Liberty Auction and Realty.
There will be a 10% Buyer’s Premium added to final bid price to determine the final selling price.
Payment must be made before item(s) are removed by the specified date on the auction advertisement.
Liberty Auction and Realty has put forth every effort to make accurate
descriptions of the items. Printed or verbal statements made by staff are matters of opinion and are made in good faith. However, all items are sold "AS IS WHERE IS." You are responsible for your own inspection if an inspection date is available for the sale.
All Sales are Final. WE DO NOT SHIP ITEMS. The successful high bidder of each item agrees to pick up items on scheduled pick up date. If a payment is made by credit card a surcharge of 3.5% will be added, it must be made prior to pick up. All payments made at time of pick up must be cash or good check. If an item is missing or damaged at the time of pick up, the buyer is not obligated to buy that item and has no further recourse against the seller or Liberty Auction and Realty.
Liberty Auction and Realty reserves the right to reject any and all bids for any reason prior to the close of bidding.
Liberty Auction and Realty reserves the right to cancel this auction, or remove any item or lot from this auction prior to the close of bidding.
Bidder Verification: The identity of all bidders will be verified. Bidding rights are provisional, and if complete verification is not possible, Liberty Auction and Realty will reject the registration, and bidding activity will be terminated. The Seller and Liberty Auction and Realty reserve the right to preclude any person from bidding if there is any question as to the person’s credentials, mental fitness, etc

Bidders agree to keep their username and password confidential as they are responsible for ANY and ALL activity involving their account. If your USER NAME is offensive to Liberty Auction and Realty then we reserve the right to terminate your bidding.
When using the web site you must obey any and all local state and
federal laws. Violations will result in termination of web site use privileges. Auction company employees and/or auction company may bid on this auction. We gather aggregate information from this web site which may include but is not limited to: number of page visitors, most visited pages, any and all correspondence.
DEFAULT: If purchases are not settled by the specified pick up day, it will be considered in default. Upon default the bidder will be black listed/blocked from bidding on Liberty Auction and Realty auctions, as well as MarkNet Alliance auctions and may be charged 10% of bid price or $500, whichever is greater. All defaulted items may be offered to the next highest qualified at the discretion of Liberty Auction and Realty.
Any dispute between Liberty Auction and Realty, its Agents or Representatives, and the Buyer(s) will be tried in a court of jurisdiction in Henderson County, TN. By bidding on the property, buyer agrees to all terms and conditions set forth.

REAL ESTATE AUCTION TERMS AND CONDITIONS
1. A 10% BUYERS PREMIUM WILL BE ADDED TO THE FINAL BID TO REACH THE TOTAL SALES PRICE AND TOTAL CONTRACT PRICE FOR REAL ESTATE AND PERSONAL PROPERTY.
2. TERMS ON REAL ESTATE ARE 20% DOWN THE DAY OF AUCTION; BALANCE DUE WITHIN 30 DAYS UPON DELIVERY OF DEED. PAYABLE BY CASH, CASHIERS CHECK, OR PERSONAL CHECK. TAXES WILL BE PRORATED.
3. BUYER IS RESPONSIBLE FOR TITLE SEARCH, IF DESIRED. BUYER IS ALSO RESPONSIBLE FOR STATE TRANSFER TAX, RECORDING OF THE DEED, AND THEIR PORTION OF THE ATTORNEY FEES.
4. LIBERTY AUCTION & REALTY AND ALL AGENTS WORKING AT THIS AUCTION ARE ACTING AS AN AGENT FOR THE SELLERS.
5. ANY REAL ESTATE TERMS AND INFORMATION SUPPLIED IN THE TERMS AND CONDITIONS CONCERNING TAX AMOUNTS AND OTHER INFORMATION ARE SUPPLIED TO ACCOMMODATE THE PURCHASER(S). IT IS THE PURCHASER’S SOLE RESPONSIBILITY TO HAVE COMPLETED THEIR OWN DUE DILIGENCE, SURVEY, RESEARCH, INSPECTION, AND SHALL BID ACCORDING TO THEIR DUE DILIGENT SURVEY

11. PURCHASER(S) ARE INFORMED THAT THE SELLERS AND LIBERTY AUCTION & REALTY ARE NOT EXPERTS OR QUALIFIED TO OFFER ANY INFORMAITON CONCERNING ENVIRONMENTAL HAZARDS, ASBESTOS HAZARDS, ETC. AND MAKE NO WARRANTY, GUARANTEE, OR STATEMENTS IN CONNECTION WITH SUCH.
12. AUCTIONEER AND BROKER ARE NOT EXPERTS IN DETERMING ENVIRONMENTAL HAZARDS AND HAZARDOUS MATERIAL. PURCHASER ACCEPTS THIS PROPERTY IN ITS PRESENT CONDITION, AGREES TO HOLD HARMLESS THE BROKER, HIS AGENTS, AND LIBERTY AUCTION & REALTY FROM ANY ENVIRONMENTAL HAZARDS AND THE COST TO DEFEND HIMSELF, HIS AGENTS, OR LIBERTY AUCTION & REALTY FROM ANY CLAIMS.
13. PURCHASER HAS HAD THE OPPORTUNITY TO INSPECT THIS PROPERTY AND WILL MAKE ALL BIDS AND PURCHASE SAID PROPERTY AS A RESULT OF THEIR INSPECTION.
14. ALL PROPERTIES SOLD BY CURRENT DEEDED DESCRIPTIONS.
15. PURCHASER(S) SHALL BE RESPONSIBLE FOR THEIR OWN LIABILITY INSURANCE AND CASUALTY INSURANCE FOR THEMSELVES AND THEIR EMPLOYEES AND AGREE TO HOLD HARMLESS LIBERTY AUCTION & REALTY AND THEIR SELLERS.
16. ALL THE BIDS WILL BE SETTLED FROM THE AUCTION STAND BY THE AUCTIONEER AND HIS DECISION WILL BE FINAL. THE AUCTIONEER HAS THE RIGHT TO RE-OPEN THE BIDDING AND PUT THE PROPERTY UP FOR SALE TO ALL BIDDERS.
17. AUCTIONEER AND AUCTION STAFF RESERVE THE RIGHT TO BID OR EXECUTE ANY ABSENTEE BIDS, PHONE BIDS, OR OTHER BIDS THAT ARE TURNED IN TO THEM.
18. ALL INFORMATION USED IN THE ADVERTISING AND PROMOTION OF THIS AUCTION HAS BEEN OBTAINED FROM PUBLIC RECORDS AND OTHER SOURCES DEEMED TO BE RELIABLE AND ARE TO BE TRUE AND CORRECT. NO WARRANTIES ARE MADE TO THIS EFFECT.
